1. Ticket Purchases: All ticket sales are final. No refunds, exchanges, or transfers will be issued unless an event is canceled by The Kickback. If an event it postponed or rescheduled, purchased tickets will remain valid for the new date unless otherwise determined by The Kickback. Tickets must be presented (digital or printed) for entry. A valid government-issued ID may be required for admission or alcohol service.

2. Alcohol Policy: Alcohol is available only to guests who are 21 years of age or older with valid identification. Bartenders receive the right to refuse or discontinue alcohol service to any guest who appears intoxicated or violates venue policies. Unlimited drink packages are subject to the event's beverage guidelines, including wristband or stamp verification and one drink per order.

3. Photography, Video, & Media Release: By purchasing a ticket or attending a Kickback event, you acknowledge that photography, videography, livestreams, and audio recordings may occur. You grant The Kickback, its owners, employees, contractors, affiliates, sponsors, and marketing partners the unrestricted, perpetual, worldwide, royalty-free right to photograph, record, reproduce, edit, publish, distribute, display, broadcast and otherwise use your name, image, likeness, voice, appearance, and statements captured during the event for any lawful purpose, including but not limited to:  ​

• Advertising 

• Marketing

• Social Media

• Website Content

• Promotional Materials

• Television or Streaming Platforms

• YouTube Videos

• Interviews

• Highlight Reels

• Future Event Promotions

 

No compensation, royalties, or additional approval will be provided for the use of such content.

4. Ownership of Content: All photographs, videos, interviews, graphics, logos, branding, event footage, promotional materials, and other media created, recorded, or published by the The Kickback are the exclusive intellectual property of The Kickback. This includes, but not limited to:

• Event Photography

• Crowd Footage

• Artist Performances

• DJ Performances

• Host Apperances

• Guest Interviews

• Behind-the-Scenes Footage

• YouTube Videos

• Social Media Posts

• Website Content

 

No Content may be copied, reproduced, downloaded, edited, redistributed, or used for commercial purposes without the prior written consent of The Kickback.

5. Artist Performance Recordings: Artists, performers, DJs, Speakers, and Entertainers acknowledge that their performances may be photographed and recorded during Kickback events. Unless otherwise agreed in writing before the event, The Kickback retains the right to use recordings and photographs of performances for promotional, marketing, advertising, documentary, archival, social media, and YouTube purposes without additional compensation.

6. Assumption of Risk: Attendance at any Kickback event is voluntary. By attending, you assume all risks associated with participation, including but not limited to accidents, illness, personal injury, property damage, theft, or other unforeseen incidents.

7. Release of Liability: To the fullest extent permitted by law, you release and hold harmless The Kickback, its owners, officers, employees, volunteers, contractors, sponsors, venue partners, affiliates, vendors, and agents from any claims, damages, losses, liabilities, expenses, or causes of action arising out of or relating to your attendance or participation in any event.

8. Code of Conduct: The Kickback reserves the right to refuse admission or remove any guest without refund for:

• Disorderly Conduct

• Harassment

• Fighting or Violent Behavior

• Illegal Activity

• Possession of Prohibited Items

• Failure to Comply With Venue Rules or Staff Instructions

9. Event Changes: The Kickback reserves the right to change event dates, times, venues, entertainment, schedules, vendors, or programing without prior notice when necessary.

10. Website Use: All content on this website, including logos, graphics, text, images, videos designs, and branding, is owned by or licensed to The Kickback Entertainment and may not be copied, reproduced, or distributed without written permission.

11. Governing Law: These terms & Conditions shall be governed by & interpreted under the laws of the State of Indiana, without regard to conflict of law principals.
